UK Developers

1) Introduction

 These Terms and Conditions (“Terms”) govern your use of our website/app and our real estate development, sales, marketing, and property management services (collectively, the “Services”) in Pakistan.
By using the Services or initiating a booking, you agree to these Terms.

2) Eligibility & KYC
  • You must be at least 18 and legally capable of contracting in Pakistan.
  • We may request CNIC/ NICOP/ passport, NTN, proof of address, and source-of-funds documents for KYC/AML compliance under applicable Pakistani laws and SECP/FBR guidelines.
  • We may decline or cancel a booking if KYC/AML checks are not satisfied.
3) Scope of Services

We may: (a) develop, build, and sell residential/commercial units/plots; (b) market projects by us or third-party developers; (c) provide booking, installment, and after-sales support; (d) offer digital tools (brochures, floor plans, unit selectors, etc.).
We may modify, suspend, or discontinue any feature at any time.

4) Project Information & Disclaimers
  • Illustrative materials only: Renders, 3D visuals, sample apartments, brochures, and site videos are for guidance. Final finishes, sizes, layouts, views, and amenities may vary due to technical, regulatory, or supply reasons.
  • Regulatory approvals: All development is subject to approvals of relevant authorities (e.g., CDA, LDA, MDA, SBCA/SDA, RDA, PHATA, or other competent bodies) and applicable building/by-laws.
  • Updates: Prices, payment plans, area statements, and specifications may change without prior notice until a Sale Agreement/Allotment Letter is executed.
5) Booking, Allocation & Agreements
  • A Booking Application + token/booking amount reserves queue priority but does not create ownership.
  • Allocation/Allotment occurs only after (i) acceptance by us, (ii) execution of the Sale Agreement/Allotment Letter, and (iii) timely payment per the plan.
  • We may reject bookings or re-allot units in case of non-payment, failed KYC/AML, or false information.
6) Payments, Taxes & Charges
  • Pay strictly per the installment schedule stated in your booking/contract. Late amounts may incur late payment charges of [X% per month or flat PKR X/day].
  • Unless expressly stated, prices exclude government duties/levies (withholding/advance taxes, stamp duty, registration fee, CVT, FED, GST, municipal charges, development charges, utility connection charges). These are buyer’s liability as applicable at payment/registration time.
  • All payments must be made through official channels designated by us (e.g., crossed cheque/PO/online transfer to [Company Bank/RDA account]). We are not responsible for cash given to unauthorized persons.
7) Handover, Possession & Utilities
  • Target handover dates are estimates and may shift due to regulatory processes, force majeure, supply constraints, or contractor delays.
  • Possession is given after full and final payment, execution of required documents, and clearance of dues.
  • Utility meters/connections (e.g., WASA, SNGPL, KE/IESCO/LESCO/MEPCO, etc.) and related security deposits/fees are buyer’s responsibility unless stated otherwise.
8) Developer’s Rights to Alter

We may reasonably re-plan, re-align, or adjust layouts, areas, floors, elevations, materials, and MEP systems to meet legal/technical requirements. In case of material change in net saleable area, price will be pro-rated (increase/decrease) using the contracted rate per square foot/square yard.

9) Cancellation & Refunds
  • By Buyer: If you cancel before Sale Agreement, [booking fee X%] may be non-refundable. After Agreement, cancellations follow the Agreement’s terms.
  • By Company: We may cancel for default/non-payment after stipulated notices. In such case, deductions (e.g., [admin fee %, marketing fee %, holding cost]) may apply and balance (if any) refunded within [X–Y] days after resale/settlement, as per Agreement.
  • Refunds are paid only to the original remitter via banking channels after due verification.
10) Brokers/Channel Partners

If you interact via an agent/broker registered with us, note that only written offers/receipts issued by [Company Name] are binding. We are not liable for unregistered/unauthorized intermediaries’ representations or side promises.

11) Warranties & Defects Liability
  • Construction quality: We warrant that construction will follow applicable codes and approved drawings.
  • Defects Liability Period (DLP): For [X–12] months post-possession, we will repair manufacturing/structural defects attributable to us. Normal wear/tear, misuse, or third-party alterations are excluded.
12) Use of Website/App (Acceptable Use)

You agree not to: (a) attempt unauthorized access; (b) scrape or copy content without permission; (c) upload malware; (d) post unlawful or defamatory material; (e) infringe IP rights.

13) Intellectual Property

All logos, marks, text, designs, drawings, photos, renders, and software on the platform are our or our licensors’ intellectual property. No reproduction without written consent.

14) Data & Privacy

We process personal data in line with applicable Pakistani data and cyber laws (e.g., PECA 2016) and our Privacy Policy.
By using our Services, you consent to collection, use, storage, and cross-border processing (where applicable) of your data for KYC, transaction processing, and customer support/marketing (opt-out available).

15) Compliance, AML/CFT & Sanctions

We comply with Pakistan AML/CFT requirements. You must not use our Services for unlawful activities and you authorize us to file STRs/CTRs with relevant authorities where required.

16) Limitation of Liability

To the maximum extent permitted by Pakistani law, we are not liable for: indirect or consequential loss, profit loss, or delays caused by force majeure (acts of God, pandemics, government actions, court orders, strikes, supply chain disruptions, etc.).
Nothing limits liability for fraud or willful misconduct.

17) Indemnity

You agree to indemnify and hold harmless the Company against claims, damages, and costs arising from your breach of these Terms, misuse of the Services, or violation of applicable laws.

18) Dispute Resolution & Governing Law
  • Governing law: Laws of the Islamic Republic of Pakistan (including relevant provincial laws and authority by-laws).
  • Arbitration (recommended): Any dispute shall be finally resolved under the Arbitration Act, 1940, by a sole arbitrator appointed per [appointment method]. Seat and venue: [City: Karachi/Lahore/Islamabad].
  • Courts of [City] shall have exclusive jurisdiction for interim relief and matters not referable to arbitration.
